Drop the So-Do-Me case

Under the Medical Act, a medical report made by a registered doctor is considered a valid official document.

The medical report by the Burmese doctor stating that there is no obvious penetration sign should be accepted as a valid document. If that is the case, then the whole sodomy charge is no more valid.

Under such circumstances, if the investigation still carrries on, it would have given a perception that this is persecution of an enemy political foe. The police should ask themselves: If the accused is just an ordinary citizen, with such a medical report, would the authority still proceed with investigating the case??

Furthermore, the doctor is a foreigner, and has no direct interest in the politics of Malaysia. He is also an experienced doctor. Even a competent house officer would have known what is a tear and what is bleeding. So his competency should not be questioned. Anyway, In any rape case, the evidence of the first doctor examining the case is of utmost important; and looking at past examples, most of these doctors who testified in rape cases are not forensic doctors and are medical officers in the A & E Dept.

As such, I would like to ask the authority to drop the case. Let us focus on things that are more important to the rakyat.

P.S. How the report was leaked and how the confidentaility between patient and doctor is breached, by all means investigate… But that is another matter altogether..

    One of the main reason…UMNO wants all to forget Lingam case..5 Hindraf under ISA…and the murder case.

    Hi doctor, there are now 3 other doctors who have come up and refuted the accuracy, reliability and question whether the report is indeed conclusive or not. Would like to hear your comments on those reports too.




    I just think it’s important that we don’t only see it from one angle. Will be awaiting your comment on this, Doctor. and the first Doctor sounds like a specialist in the area too.

    Charlie, first of all, just like a rape case, if the woman is not struggling and submitted without struggle, ewould probably be no tear just like a normal intercourse. But if they are struggles, there would be marks, bruises maybe, tears maybe.

    SImilarly, if the anus is penetrated with the accused struggling, there would be tears. It is much more difficult to penetrate a anus than a vagina, because the opening is smaller and there is a anal syphinster.

    For doctors to do procedures, we normally use a gel or a jelly to lubricate the instruments, otherwise it is very difficult to insert the proctoscope inside. Ask the doctors mentioned above to insert a proctoscpoe without lubricants, chances are minor tears and bleeding may occur.

    If the person is struggling, it will be almost impossible to do so, unless of course, the person is a willing party, and the anus has been subjected to penetration of the same kind many times. even then, there would be other signs, like easy insertion, looser anal tone etc…

    The point is: if the doctor is a registered doctor, then his opinion is legally binding, unless he is proven to be incompetent. Whether notes or report, if it is his opinion , it is the same, whether it is printed nicely or written in his own handwriting. So if this type of report is normally accepted as evidence in normal persons, then the same rule should apply here, VIP or no VIP, there should be no differrentiation, remmembering that all men are equal under the law.

    Of course, doctors can debate for and against. As i have mentioned, Malaysians are now divided into either u r for or u r against.

Since you are a doctor and you have no hidden agenda. Like all Malaysians, we just want to get over with this sodomy thing and get the economy moving. Things are really getting ‘dark’ in Malaysia!

    Somewhere I red that like in all rape cases, the doctor would suggest the victim to check further with government hospital for confirmation. This is apparently also the case with this pusrawi doctor. It is said that he suggested the vidtim to go and check with government hospital. Why are you on the other hand quick to suggest that the police drop the case immediately? In your own writing it seems that many possiblilities can appear depending on condition of the act, struggling or not etc. And, you are convinced with two page of notes to conclusively believe that it didn’t happened? I find your logic so loose. What is there to be afraid of if it didn’t happened? Why not have a through check, and if need be insist on an independent professional observer? Why so quick to conclude and agree? why?

    There is a posting of MCA PJ Utara’s press statement on the mentioned issue in Din Merican’s blog. Rightly or wrongly, i salute their courage to stand up and voice out their opinion despite not endorsed by the parent body. This is what we call freedom of speech and opinion. Bravo !

    Our judiciary and security force’s credibility is under the microscope of international communities. Aren’t we ashame of of it. Worse still, Zaid Ibrahim revealed that he is squeeze in between where party member try to force him out of the cabinet and public opinion is mounting on his proposed reform. Seems we really in need for a Dark Knight, Doc.

He is either blind or deaf to the conspiracy plot being hatched against DSAI.     I wonder whether the police pursue other case with such fervour and intensity. There are so many things that needs urgent attention. Why so much energy and time to drag one man in the mud? This smacks of vindictiveness and desperate acts to stay in power.

    I read that in Klang robbers are targeting students who possess handphones and other gadgets. Students cant even hang around in safety within the school zone. Hi,Mr. Policeman what is this? Go do something about the situation.

    I read with disgust a letter in Malaysiakini how an excellent student ‘s application to local institutions gets fouled up and the officers lackadaisical attitude about the matter. Doesnt this merit as much attention? Here we have a student taking the arduous roadthat is less travelled and achieve scintillating results and yet is denied the opportunity. Where are we heading to? Excellence is not recognised.

    At a time when we were asked to tighten our belts there you have one state government spending millions acquiring cars of status. Is it morally right to drain the state’s coffers in this manner? What matters most is how state assemblymen renders themselves in terms of service, time and energy for the betterment of the rakyat.

    Where is this belief and fear in God as enshrined in the principles of Rukunegara. Corruption is so rampant.

    Yes DR Hsu you are right. Let us focus on things that are more important to the rakyat. Take care of the economy. Take measures to spark growth. Promote excellence in academic institutions. Retain our brains. Capitalise on brillant minds who can help to give suggestions to spur development for the country.

    Humm, my argument is not loose. The first doctor report of no sign of penetration cannot be dismissed just ike that. If u read carefully what i said, amd i have a master’s degree in medicine and almost 30 yrs experince as a doctor, there would be tears or bruise or bleeding in a forced entry.

    In this case, what is reported is that the accused is an unwilling party and so this is forced entry. you can try shafting a coke bottle without lubrication, i can guarantee u will go immediately to see a doctor. What I said is that in this case, the government is talking about following procedures and law. And in law, the opinion of a registered doctor carries weight in this type of cases. Why selectively ignored this doctor’s opinion? it is similar to getting medical certification for insurance purposes and medical sick leave, A doctor’s opinion is accepted as long as he is a duly registered doctor.

They even named these people “anwaristas” 😉 And thanks for your interpretation of those articles too Dr Hsu. I really think the net users should also actively participate in gaining info not only what they “believe” but get FACTS facts FACTS. Nothing wrong with that. But you know what they say, once you reallly believe and feel Anwar is innocent, even the strongest of evidence cant make you change your mind.

    But I bet there are a handful of people still able to make rational judgements about issues.

    Thanks for your input Dr Hsu. It’s always refreshing to hear someone making a fair comment on the issue at hand. Another question is though, is it a requirement in law that in cases of sodomy allegation, an examination by a specialist is required? Just like, for example the rape kit in a rape case? That’s more of my concern, actually. On the point of struggling, tears and bruises, Heaven only knows what happened (or did not happen) between the two. Promises of power and positions are very powerful sedatives, so we might have a willing participant for all we know. Hence no tear or obvious signs of struggle? I’m not siding either Saiful or Anwar here. And Anwar’s camp has yet to address the findings that Dr Osman is linked to Anwar and they worked closely many years ago. If so then would Dr Osman not be considered an “interested person” and hence his opinion SHOULD be disqualified? The law does make sure that evidence admitted is from neutral parties, and for a valid reason too.

    daffodils, I agree with you too and I wish more attention could be channeled to non high-powered drama case like these. But it’s yet too early to say with the highest degree of certainty that the man in question is being dragged to a mud-bath.

    Dr Hsu, thank you for your response. After all I’m sure we are all for the same thing, ensuring justice with a clear facts so that when decisions are made it is based on good judgement and fair for all.

    I assure you that I do take into consideration you vast medical experience and hence seek your clarification on matters. With due respect, however, we do have differing medical opinions out there. As noted somewhere in the discussion earlier, there are at least 3 other sites that have their own opinion on this issue. Now, let’s not start with I’m right and you are wrong. Certainly this is not how most scientific discourse are done. It has to be done on established facts, data, evidence, and not just my numbers of years experience is more than yours.

    Anyway, lets move on. I don’t believe there is any statement anywhere that says the first medical report is dismissed totally. It cannot be, and i don’t think it ever will. Once an opinion is made, it is there to be reviewed. And I am sure should this matter goes to court, the veracity of the report will be questioned, as it should be.

    Now, surely the matter at hand is not merely a medical issue. There are many others such as legal and sociological side of it. From the legal standpoint, I believe that is why the doctor is advising the patient to get a more through check in a government hospital. Imagine going to court with just two pages of notes and saying conclusively that he was actually sodomized. So, I believe having a through check up is not just appropriate but a must. This is a serious matter. You are sending someone to jail for a very long time.

    The society on the other hand also demands that justice is seen to be done. Imagine if our own son or daughter is raped. Are we content with just a cursory review and case dismissed? Surely not. What is not good for us is it acceptable for others?

    Charlie, the law does not state that rape or sodomy victims must be examined by a specialist.

    That is why , if you care to read court cases on rapes and sodomy in newspapers, for those cases in smaller towns and rural areas, the doctor who testified are usually medical officers running the district hospitals.

    It is only when doubts occur, that specialist opinion are sought, BASED ON THE FINDINGS of the first doctors, because any injuries or signs aorunf the private parts may not be so obvious after some days… so the critical parts are usaully the first doctor’s findings.

    In big cities and towns where specialists are available, medical officers in A & E units who first see this type of cases do refer to the specialists. Many do so just to cover themselves legally, so that when the defendants lawyers drilled the MOs, he can always fall back on the specialists, lettig specialists take the flaks, figuratively speaking…

    In law, what is important is that the doctor is a duly registered medical practitioner.

    Do you know that for a doctor applying overseas registration, eg. to register with British Medical Coucil, the degree they asked for is the basic degree, MBBS, MBCHB, or MD (from North America/UKM)? If the basic degree is not recognised, even if you received your specialist training from Johns Hopkins (the best known medical school in the world), you will not be able to register with the council? I know because I am registered with BMC.

    Do you know even GP in overseas are considered a specialist in Family medicine? In the States, they go through GP residency just as other speciality. A & E is also a speciality , just for your info. Same as NZ and Australia. For most rapes case, the first doctor attedning to it is usally aGP or a A & E doctor. BUt many GPs in Malaysia would not want to see these cases, and they would just redirect the patients to hospitals, not for anything else but for fear of getting involved in a court case, which would mean many days away from their practice and loss of substantial income…

    You can criticise the doctor for not being thorough, but that does not remove the fact that he is a duly registered doctor…And his opinion does carry weight in a court of law, if ever the court of law really practices good ethics and fairness..The doctor also must be a party that has no interest in the case, which applies in this case.

    What i am saying is that in a normal police case of rape, if the first doctor gave an opinion that there is no signs of intercourse or forced entry, in a normal case, the police will not pursue any further, especially if the accused has reliable alibi.

    I have said above that you can argue for and against…. Basically this is because the credibility of the police and the judiciary is so low. If this case is tried in an independent court like overseas, with 12 member jury making the judgement, most of the rakyat would have accepted the verdict, either for or against. It is precisely because justice is seen to have been compromised that whatever things happening is now deemed to be doctored….It bears down to the basic fact that the whole government institution has lost its credibility…

    Small people like us, in the case of being maligned , will have no other discourse if the court is deemed to be no longer independent. This perception has actually been confirmed by none other than a Royal Commission on Lingam Tapes.

    Police credibility has been lost ever since the case of the exIGP assaulting a former detainee resulting in a black eye…. All these are proven to be true. Even immigration dept, the guradian of our entry is seen to have been compromised… What else?

    So , we must act together to push for a independent Police and judiciary, and a civil service that is fair and impartial… And a good start would be a totaly indepednent ICAC , like Hong Kong. Cases like the proton perdana fiasco would not happen if there is an independent watchdog…

    I second what Dr Hsu suggested. That is what we are lacking, an independent reliable reviewer. I don’t believe we should be afraid of a second thorough review but must insist of its independence. Hiding behind conspiracy and all does not address factually of what did or did not happened. We must not only be fair but be seen to be fair.     Once people’s perception that our judiciary is corrupted and lost confidence in it, that will be the end of story as people has no elsewhere to seek remedy.

    Judiciary is the last line of so called ‘defence’ to us. Take for example, if all other part of a country’s system are corrupted (which include police, hospital, AG office, administrator and so on), but judiciary is still clean and independence, then we people have the ‘last avenue’ to seek justice in the court of laws.

    The situation of Malaysia is, I would say, ‘very near’ to such kind of scenario that I depicted above. That is the reason why I commented before that if the authority wants to go ahead with sodomy charge against Anwar, then ideally, this case should be tried by ‘Privy Council’, a reknown independent institution that legal circle seek precedences in litigation.

    If this suggestion of mine is not accepted by virtue of ‘face saving’ or other reason, then the case should be tried by ‘Syariah Court’, which I think is proper since both parties claimed that they are more Muslim than the other as what we seen in willingness in swearing under ‘Quran’.

    Humm, I got your points but I am sceptical over the whole episode the investigation is conducted. Just hope that those involve in this case still have conscience with them. Truth will prevail, ultimately.

    When the clock struck 12 on Aug 30th 2007, my wife and I were at Dataran Merdeka to usher in the historic occasion of Malaysia’s 50th Independence celebration. I still kept all the pictures and video clips which I took of that special night. But do you know that iBodowi spoilt it by shouting merdeka only 6 times instead of the requisite 7 times? Don’t beielve? I have it on tape. I have replayed that tape so many times in case I heard it wrongly but I know what I heard. That is our PM. A real kampung idiot. I have no more respect for him and the entire cabinet of eunuchs and crooks. I will save my petrol and fly my flag in my house and enjoy my day off. Thanks monsterball, good idea. It makes my day.

    “I want to correct the wrong in society,” he told Bernama here today. Chong who claimed to be an accountant and in his 50’s, said he had the proof to back his allegation and would expose it at a news conference on Aug 16.

    Yesterday, newspapers reported about the SMS being circulated, linking the alleged sex scandal involving a student from China to Wee, who is also MCA Youth secretary-general, and that he would receive the same fate as former Health Minister Datuk Seri Dr Chua Soi Lek who was also embroiled in a sex scandal late last year.

    Dr Chua quit his cabinet and party posts after a DVD recording of him engaging in sex with a woman was widely circulated.

    Wee today said he was not afraid to face the allegation because after all this while, various allegations had been made against him.

    He said what was happening of late had to do with the party elections in October.

    Chong, who has gone to Kuala Lumpur today, also claimed that he would be meeting Bukit Aman police to find out what happened to the three police reports he lodged against the deputy minister two years ago. — Bernama

    I’m in the same opinion with you. Regardless of the various medical jargons that have been decribed by this Dr. Novandri in his blog, it is still a valid report. Instead of doing justice to both RPK or Anwar, this Doctor has been mercilessly go to the detail of explaining why the leaked Medical Report is not valid while discrediting his fellow MD! So very typical of UMNO!

    I really2 feels that I want to PUKE at this Doctor. I really want to asked this IDIOT why Anwar has never been successfilly convicted in the first trials before? Why the courts has freed SUKMA from any sodomi charges while admitting the earlier confessions was done under coercion by the Police. Why this SAC Roduan tried to fabricate evidence on the mattress and why the prosecutors and the judge expunge the whole items related to this fabrications?

    To told you the truth, I’m really sad to the extent politics has been deep-rooted here in Malaysia. That is why we’re in the deep shit now! Politics can be found everywhere and wherever it touches, the conditions really stinks! Not only we have politics in the Police, the Judiciaries, the Football team and now we have politics in the Medical Profession as well. I cant understand to what extent people are willing to “prostitute” their professions, their integrity, their conscience etc. SHIT! I really2 hate these people!

    To me UMNO has cross all boundaries to the extent that there is no way for them to go back! The only way for us to get rid of them is to show them the way out, PERMANENTLY! To do that, we need to urgently be united as a Malaysian and never let ourselves to be divided by their racial cards forever!

    If Tunku Abdul Rahman could see it from his grave, surely he will cries as this is certainly not the very same Malaysia that he has envisioned to be…

    And when Dollah opens his mouth…he is shaming Malaysia with his low class statements.
    I used to g8ive him some respect.and even defended him …for 2 years…got baned at Malaysia-Today…because of defending him.
    No regrets….but since the sodomy case…this low class PM said he will defend Saiful…as the excuse…supporting a case against Anwar.
    This low class Dollah’s popularity plunged from 91%…high..in favour of him…few years ago .to now.. .49% low…believing him…….and overall..more than 75% is sick of his bugger.
    His big ears and eyes are no longer functioning.
    He is a desparado.

Let the people to open up their five sense to evaluate who can deliver.

    No one is 100 percent correct and no one is 100 percent wrong. At the end of the day, the people will make their choice known. But Gerakan is still the better choice with their idealisme and objectives. Gerakan need to play a proactive role

    Dear Dr.Hsu ,

    Under the adversarial system , the duty of the prosecution is to proof their case beyond any reasonable doubt . In sexual offences cases , the GP who performs the first examination on the victims are always called to the stand . The specialists only comes in the event there are some clarification to be done . Even then , the prosecution normally would prefer to tender the medical reports under section 399 , Criminal Procedure Code and not call the doctors to testify unless notice are being given by the defence at least 10 clear days before the hearing under the same section.

    You are absolutely correct Dr.Hsu when you say that Dr.Osman’s medical report is admissible notwithstanding that he is in private practice . The only difference is that medical reports prepared by govt medical officers are regarded as public documents prepared by a public officer under the Evidence Act 1950.

    BTW , if the specailist report seems to contradict the preliminary report , then the Courts will see not too kindly on the proecution’s case and the rule of law says that benefit should be given to the accused . THAT IS TRITE LAW !

    How come I know , well let’s just say , I’ve being part of this legal system coming for 20 years now .

    Anyway , Dr.Hsu , I would love to have you as a witness in the court proceedings if I’m a judge who presides over this proceedings.

    UMNO does NOT represents the malay although they claimed of having more than one million members.

    UMNO does NOT have any interest in the common malay as their interests are only on themselves and a group of their cronies. Many malays have accepted this as facts and are slowly, but surely distancing themselves from UMNO.

    The actions of UMNO itself does NOT have anything to do with the nature of “malay” itself. Malay by nature are simple people, peaceful, humble, polite and soft-spoken people. Certainly not those “arrogants” and outright “rude” people who now represents UMNO.

    Common malays does NOT have anything to do with UMNO. Most of them are innocents and does not even know what is the meaning of the so-called “bumi” previleges!. Some have opened their eyes to it but unfortunately, some others do not.

    Common malays are outrage of the treatment that have been handed to Anwar. Not so much as they really cares about Anwar but they simply cannot accept the way UMNO goes to the extent to maligned the Image of Anwar. Even for a much hated criminal, when they die, the malays will stop saying anything bad about the person.

    The malays seen that Anwar has been brought down and that is enough. To maligned his character with the sodomy charges and to go to the extent of convicting him is simply TOO much.

    monsterball, to be fair to anak malaysia I was following his discourse and at the same time watching “Memoirs of a Geisha” on Astro 411 which went on way past 2 am. Highly recommended; perfect ending when the Chairman confessed his love for Sayuri at the ending scene. So touching, makes me young again. And talking about astro, do watch the movie “Chaos” over at 413 star movie channel. The plot is brilliant and you will be enthralled from start to finish. What a good saturday!     I agree totally. Even among iother Malaysians, even among those who do not support Anwar, eg. certain Chinese groups, they do not agree to the tactic used against a political opponent. They perceive that by doing so, it is going back tot he path of 1988, when so many judges were dismissed just because they did not kowtow to the executive.

    I personally miss those days where neighbours exchange ‘kuih-muih’ with their Malay friends, where Malay at that time never questioned whether the ‘kuih-muih’ that we gave was ‘halal’ or not and they ‘dare’ to drink beverages that non-Malays served.

    All these were the past that I miss dearly. Another Malay culture that I miss was ‘bermaaf-maafan’ that Malay practises in those days where the youngsters seek forgiveness to their elders for the ‘wrong’ that they committed. All these are the actual colors of the Malay. Not the type of ‘arrogance’ displayed by Umno top leaders.

    If these leaders can reflect back those good values, I am very sure there will be no sodomy cases, Altantuya murder scandals and so on.

    Thanks Anak Malaysia, I appreciate your views very much. Lets work hard to bring back those good values to our society.
