Yes, Minister, you are wrong!

Article 18, Part II of the Fourth Geneva Convention  (August 12, 1949) states clearly that:

” Civilian hospitals organized to give care to the wounded and sick, the infirm and maternity cases, may in no circumstances be the object of attack but shall at all times be respected and protected by the Parties to the conflict.”

Hospitals are sanctuaries that should be respected and avoided by all warring sides. One of the reasons is that the injured and wounded are unable to defend themselves, and any honourable being will never attack or fight with anyone who is disabled or ill. The patients  are also unable to run or seek shelter elsewhere.

There are many videos and photos showing that during the rally on 709, Tung Shin Hospital, or more specifically, the  compound of Tung Shin hospital, was hit by water cannons and tear gas .

It is understandable that in the heat of flexing their muscles against unarmed civilians , some of the personnel might have forgotten that hospitals are sanctuaries to be avoided. I suspect some may not even have heard of the Geneva Convention, given the state of our education system. So it was actually understandable that some might have been so caught up that they fired their gas canisters and water cannons into the compound of the hospital.

Afterall, humans are fallible, we are not God. But when a person has erred, he must be prepared to learn from his mistakes and apologise for his error, and accept any  punishment for making the error if it is serious enough to warrant such punishment.

The correct response from the powers that be, including the ‘honourable’ Home and Health Ministers, should be the acknowledgement of such attacks in the presence of irrefutable evidence   and issuing a sincere apology to the patients, staff and management of the Hospital, and a promise that such nonsense would never happen again.

Instead, we have seen the bungling act again. In reacting instead of responding, their first act was that of a denial. When evidence shows otherwise, one of the Honourables even stated that he was merely conveying what he was told by the hospital board, who must be so intimidated or outdated that even their own doctors have come forward to refute their claims.

The statement by the 11 brave doctors working in TungShin Hospital clearly shows that what were captured in pictures and videos did happen. These are professionals who have nothing to gain by coming out with such a statement. They are the neutral ones who speak so that the truth can be seen and heard.

In the light of all these evidence, perhaps an apology by the PM  should be tendered .  In many other democracies, this sort of bungling would have led to voluntary resignations of the ministers involved. Resigning not because anyone  had knowingly ordered the attacks ( I don’ t believe any one in their right minds would do that),  but rather  as a sign of taking responsibility.

This is what  responsible government is about!

I presume you attained your degree in nutrition from the UKM and I also did some research and found that you have a MBA from Univ of Malaya. So, you are definitely well educated.     Thank you Dr. Hsu for sharing. We are also elated too by the actions shown by the other 11 doctors. I am sorry that we are caught up in a system where denials, spinning and a whole load of undesirables rule the day; when even the brave King had to speak out unprecedentedly. The blessing is that we have many conscientious Malaysians. Hopefully there would be a change for the better no matter who administers the country. But the quality of the populace and their level of consciousness is perhaps would be decisive.

    Please allow me to applaud and salute those brave doctors for presenting the truth.

    At the same time I would also like to ask that Mr Ng of the Board if he feels lonely now, being deserted by his partner in crime. Now you’re on your own, man, when you face those brave doctors and your staff don’t look at the floor, the shame must be handled like a man! The least you can do is apologise to your staff, they were there to brave the teargas so they can serve your patients.

    In a state of war, how do we view soldiers who spray bullets into a hospital if the enemy had seeked shelter in one?
    The demonstrators were seeking shelter from harm, being attacked by our own policemen who were supposed to be protecting them !!! As a person who’s never had any contact with weapons I would know not to shoot teargas near innocent bystanders, let alone a hospital, knowing the wind can carry the gas around.

    Do they not think that this act of condoning the teargasing of a hospital by the police is dangerous and to openly lie to protect them would give them greater courage the next time? Remember that poor teenager who went for a joyride in his sister’s car?
    Can one imagine cops spraying bullets into a crowd in the market in pursuit of a snatch thief. They would too, knowing they’ll be protected by not only the Home Minister but the Health Minister as well !!!

    Mr Liar, how do you face your children, poor souls.

    Liow is just his normal self and try to live up to his last name sound alike ‘Lie’ in English. It has nothing to do with his qualifications,etc.
    Then, there is Ng Beh Thong, the Chairman of Tung Shin, who instead of complaining about water canons and tear gas directed at the hospital decided to back Liow. Ng would be better off behave like the three monkeys – See nothing, hear nothing say nothing, for was shamed the very next day when the doctors came forward and spoke the truth.
    Both Liow and Ng should learn from the doctors in the spirit of Confucian teaching. The doctors can teach the two of them the meaning of INTEGRITY, TRUTH, BERSIH.
    Stop doing the opposite! Saudara Liow and Ng!

This great explanation was colluded by that Mr. Ng (silly looking old man). Another great deed. To add insult to injury, Chua Soil Leg @ Dick Head said the water cannon was aimed 40 degree upward based on pictures displayed. What a joke, he can even measure the angle of the water spray.

    Anyway, since Mr Leir has beenproven to be a liar, do you still believe his qualifications are genuine? No point in talking to questionable characters like Liow Tiong Lier and Chua Soil Leg @ Dick Head.

    While commending your enthusiasm in trying to shed light on events that transpired in or near Tung Shin Hospital on 9 July 2011, I am of the view that your quotation from the 4th Geneva Convention of 1949 is selective, incomplete and outside the context of events of 9 July.

    In the interest of transparency, objectivity and impartiality which I am sure you and strongly believe in, I would urge you to include relevant definitions as contained in the common articles of all 4 Geneva conventions.

    I wish to further emphasise that the Geneva Conventions, i.e. international humanitarian law are only applicable in situations of armed conflict which 9 July was clearly not. Therefore such references are misguided.

    As for your argument that Geneva convention is for war only, yes, it is legally correct. But if we don’t even want to do that to our enemies at war, should we do to our fellow citizens, from the civil society? So morally it should be applied to all situations, even during peace.

    Hospitals are sanctuaries, no one can deny that..

    Thanks for your immediate response. I don’t deny that something obviously happened on that day, but as one commentator posted above, educated people read your blog. As such, i think it is incumbent on educated persons to maintain certain degree of perspective on the issues at hand. All concerned parties must adopt self-critical approach in building better Malaysia. I wish to also emphasise that peaceful dialogue and negotiations always better than confrontational approach or stance.

    Key lessons we hope that Govt would learn from 0907 should include among others, to revisit or review police SOP when dispersing crowds, to improve and clarify process for issuance and approval of permits for public gatherings inc. rallies and street marches

    On the other hand, Bersih and supporters should also be prepared to clearly indicate its commitment and readiness to uphold rule of law including by firstly bringing itself into compliance with existing legal provisions. Although saddened by the death of the march participant, it is precisely to have clarity on issues such as this that it is important for actions by all parties to be guided by law, so that responsibility may be ascertained and for the situation to be redressed and remedied as appropriate.

    jaa3818. Can I say you are naive or just dont want to see the truth. All that needs to be improved in PDRM is already in the IPCMC report. Beside all the proper SOPs are already in place, prepared and enhanced by many honourable and professional police officers over a long period of time. The problem is that the police is interfered by the politicians and hence their misbehavior. The present home minster had been issuing directions down the line bypassing the police chain of command. This is not legal. You can verify this yourself.

    In it, i mentioned this:
    Amidst the rise in temperature, one sane voice was heard. It was from none other than the beloved King, who advised that both sides should find a solution amicably. The PM also made a sane decision by offering to allow the rally to be held in a stadium.

    The King’s advice actually presented an opportunity for all sides to back down without losing face which is ever so important in Malaysian society.

    Instead, the famed arrogance and flip-flopping emerged again. Instead of finding a solution, the authorities were seen trying to create more problems.

    When Bersih is backing down and accepting the stadium offer by the King, who did not want to negotiate?

    The whole exercise has been one of Public Relation disaster…

    If hospitals should not be attack in times of war is it alright to attack them in times of peace or civil unrest not amounting to war? Your interpretation of the Geneva Convention with regards to hospitals is extremely narrow and is nothing more than seeking refuge in splitting hairs.

    What perspective do we need to maintain in this scandalous act inflicted on Tung Shin hospital? There is no perspective any reasonable man can take here except to condemn the despicable action of the police.

    Please don’t patronize us with “I don’t deny that something obviously happened on that day”. What a mild statement with regards to a deeply outrageous incident. This is like witnessing a man knocked down by a car and saying “something spilled on the road today”.

    If you don’t feel any outrage with the video, photos and eyewitness accounts or disgusted by the shady action of the Health Minister to deny the incident, I’m afraid there is no hope for you as a caring human being.

    If your intention is to do damage control on behalf of BN, you have failed miserably by taking an overly pedantic and dispassionate attitude. Do better next time.

    To both Dr Hsu & jaa3818,

    Dr Hsu referred to rules from The Fourth Geneva Convention when commenting and criticising police behaviour during 9th July. According to jaa3818, rules from The Fourth Geneva Convention are irrelevant to the situation during 9th July because there was no situation of armed conflict.

    The way I understand the article, Dr Hsu was referring to the rules from The Fourth Geneva Convention merely as a guide to police behaviour when dealing with the Bersih 2.0 rally participants. It appears to me that jaa3818’s thinking is one-dimensional. Because we are not at war, The Fourth Geneva Convention cannot apply here!

    On the point brought up by jaa3818 that “international humanitarian law are only applicable in situations of armed conflict”, from all that I have read and heard so far, the events of 9th July appear to me to be situations of armed conflict. Bersih 2.0 organised a rally with no intention for the rally to be an event of armed conflict. Unfortunately the rally was turned into a situation of armed conflict, although any conflict was perpetrated by one side, the police. The well armed police force was inflicting force, pain and brutality against unarmed rally participants.

    I hope jaa3818 will not tell us that water cannons shooting out chemical-laced water, tear gas, truncheons and other miscellaneous weapons (excluding guns and samurai swords) cannot be considered to be weapons. If he does, then someone else may in turn tell us that guns, rockets, cannons and samurai swords too cannot be considered weapons. Shall we then decide that for a situation to qualify as an armed conflict, nuclear weapons must be used.

    Perhaps jaa3818 should volunteer to get doused with chemical-laced water, smoked by tear gas and whacked by truncheons and then tell us if such weapons used by police qualify to be classified as weapons. He can then also tell us if a one-sided conflict, one where one well-armed party inflicts pain and brutality on the other unarmed party, can qualify to be classified as an armed conflict.

    On jaa3818’s statement: “I wish to also emphasise that peaceful dialogue and negotiations always better than confrontational approach or stance.”

    I hope jaa3818 has not been congratulating himself with the illusion that he has just discovered a new philosophy regarding “peaceful dialogue and negotiations” vs “confrontational approach or stance”. It is an old philosophy which almost everyone are aware of and which decent people espouse. From my observations regarding the background to Bersih 2.0’s 0907 event, it appears that it was the police who either refused to negotiate or chose to shift goal-posts as negotiations were proceeding.

    On jaa3818’s statement: “Bersih and supporters should also be prepared to clearly indicate its commitment and readiness to uphold rule of law including by firstly bringing itself into compliance with existing legal provisions.”

    By this statement, jaa3818 clearly implies that Bersih and supporters had not clearly indicated their commitment and readiness to uphold rule of law. Quite a serious accusation to make without supporting evidence.

    On jaa3818’s statement: “Although saddened by the death of the march participant..”

    In view of jaa3818’s other statements and opinions, this statement expressing sadness appears to me to be hypocritical.

    Finally I wish to opine that not only should the police not have chased and attacked the rally participants in the hospital compounds, they should not have attacked the participants at all, even outside of the hospital compounds. Water cannons shooting chemical-laced water, tear gas and truncheons are meant for use only against rioters, and not against peaceful and unarmed rally participants. So far, has the authorities supplied us with any evidence that the Bersih 2.0 participants’ behavior even remotely resembled rioting, or was about to turn into a riot?

    CSL is a former HM.LTL is the present HM.Both of them are doctors.In war and peace time doctors risk their lives to save patients.Here we have a HM and an ex HM,both doctors by profession trying and lying their asses off to try to save attackers of their patients.

    So what these two pariah assholes are saying is that if these same attackers were to invade their homes and attack their wives and daughters they both would lie their asses off for them too.After all pariahs,lapdogs and traitors have no loyalty.
    Another point to note is i have never ever trust this guy LTL since day one. He has played out his former boss OngTK AND OPTED FOR A PORN STAR INSTEAD. I guess being honest and with guts like OngTK will never survive in Bolehland more so in MCA. You can be right, but you can also be DEAD RIGHT!!

    Talking about yellow, our dear PM must have yellow butterflies in his stomach before he met with Queen Elizabeth II, who was most elegant and graceful in her yellow dress. The meeting room was equisitely decorated with palatial furniture and yellow flowers lending matching colours to whole yellow pictureque setting, reflective of the royal colours and that of a ‘clean ‘ movement. There is so much humour, wit, subtle ‘poetic justice’ to the democratic world. The whole world knows by now what actually is happening in Malaysia as to the yellow movement.

    The British summer has so much in common with the Malaysian summer, which is waiting for a new ‘Spring’.

    I believe we should have more such rallies, at the least to show the kind of stupid politicians that is governing our country, those who got there by the patronage systems, instead of on their merits.

    On Al-Jazeera none-the-less, a Minister arguing with journalist in rather poor English for the whole world to see, as if he is speaking to Bernama or TV3 who is under their thumb.

    Makes me really ashame to be Malaysian, with such pariah level Ministers.

    Indeed, the cost of living in Australia has gone up much higher than the last time I visited 2 years ago ( I suspect the rate of increase is even higher than what we are feeling here despite their strong currency.. but i am not expert on Australia and this is just my perception).. It is not just the exchange rate but the price of goods and services have gone up.

    It is a global phenomenon indeed, and the young people are the ones hard hit, and in turn the older generations are hit too since they have to help out the younger generations.
