Documents of the alleged conversion

I wish to post here a few scanned documents regarding the alleged conversion of the Late Gan Eng Gor.

I urge the readers of this blog to go through these documents carefully and make your own conclusion, bearing in mind that the late Gan had been paralysed for 2 years as he had a severe stroke in 2006 according to the letter by the family which was published in an earlier post today. The conversion was alleged to have taken place on 3rd July 2007.

    Even the documents were not treated with dignity. No Commissioner for Oath, spelling error on Buddha and bla bla bla. This only show lack of professionalism and tidak apa attitude of authorities involved.

    Are you telling me Sharia and Civil Courts accepted such documents?

    his eldest son( a muslim) wants to prevent his father from entering “other heaven” by using questionable document, it is understandable since his religion require him to to do so. His son is twisted inside his mind.

    So all it takes for the Elder Son of a Gan is to press his sick daddy’s thumb against the space of the first document, with or without the old fellow’s consent and then fill up SOME of the particulars in the forms. Then hand up the forms and blimey, the family fortune is all his!

    notice the writing on top form/cert is not consistent and different style ….
    compare the top part where the particulars and the one on the date alteration….. the number “7” are different, one without a stroke in d middle of “7”???

    when I saw the photo of Mr. Gan’s wife/widow crying when they took his body away, it nearly broke my heart …. it this how u treat your mother as a son??

    Dear all,

    Sadly to say, me, as a Muslim, the entire process of the conversion is flawed. Conversion in any religion should be treated as full of dignity and honour.

    Now, the Religious Department should not taken the documents as binding because there is no proof of the deceased converting to Islam.

    In Islam, a Syahadah of a convert usually is performed in presence of witness, usually two, or more. Thus, if this “Shasaine Siau” really witness the late Gan’s Syahadah, then she will not have problem testifying in court.

    This matter could and should be brouht to court. There is too many discrepancies in the documents.This could be regarded as document forgery, and should not be treated lightly.

    May All the patience be with the family.

    The Syariah court allegedly claimed that because the non Muslim family did not turn up for the hearing, the issue was ruled in favour of the Muslim “son”. That is certainly an unprofessional ruling. The least they could have don’t was to ascertain that the documents met the requirements.

    Considering an earlier case where the Muslim party had to admit that the conversion was not done correctly, this one cetainly looks like the elder Muslim “son” had figured a way to grab the old man’s assets.

    Is this what Islam teaches it’s followers??

    sad!!!sad!!!sad!!! If religious affairs officers push non muslim harder to muslim court than they must prepare on tough question by the lawyers on their religion practice and also about their “nabi” at their own syhriah court, this is disaster in waiting. Better for all to go for civil court. The best judgement is by being practical, fairness & truth not by emotional.
    The leaders failed US!!!!. one side talk unity the side dividing policy. Non-muslim tolarated to much.

    The thing to note is that the central issue here is not the greedy son.

    Individuals are weak.

    But when an institution, an organized bureaucratic body, condones this act and empowers it with the full powers of the state in confiscating a dead body, then it underscores a systemic rot deep within the system and the ideology that propels it.

    If a bank were to take legal action against a borrower and submit such documents, the case will probably be thrown out or judgement would definetly be in favour of the borrower. Seems shariah courts have no justice and they have idiots there who dont seem to know what they are doing. Its obvious that they have been going around converting people without their knowledge and that is why the documents are in such a mess.

    It would be very interesting to question Shasainie Siau (bad meaning in hokkien) Abdullah in any court of law who had witnessed the alleged thumb print at the address stated when the senior Gan was not even there.

    The whole episode runs smacks of a hastily done con job. Is this the low standard of evidence accepted by the Syariah court or is the Syariah court an accomplice to the con job? How can such a court with a low credibility be an official court in Malaysia? It’s a laughing stock of the world!

    It is no wonder that a Syariah court judge supposedly beyond material things is caught red handed with accepting bribes recently.

    the stupid syariah and religious authorities are giving islam a bad name with their actions. Clearly the eldest son has an ulterior motive apart from believing that he is going to heaven. He may want the asset of the deceased to be under syariah where he will be the sole beneficiary. nobody will do this to their family except for monetary gain.

    Its quite obvious that the process is flawed but what’s really appalling is that the Syariah court ruled in favour of the ‘conversion’.
    I somehow believe that if a religion can so easily be hijacked, such religion may border on being a cult. Surely the keepers of the Islamic faith need to examine their protocols further before committing their ideals onto others. Otherwise, they are a long long way from civilisation as we know it.

    It appears to me thqat the Shahadah (proclaimation of faith) has not be validly effected, as there is only one witness. I personally cannot see how the ‘conversion’ could have been upheld. The presumption, I would have thought, must be that in the absence of proof that a person has knowingly converted to Islam; is that no valid conversion has indeed taken place. Any syariah lawyers out there who wish to comment?

    This is a very serious crime, if proven, to falsify documents, to body-snatch, to cheat/steal property. Legal action must also be taken against the religious authority that took away the body.

    It must be thoroughly investigated if there were wrong-doings. The muslim authority must show undisputed documents and other credible proofs to show deceased was a muslim, he is of his own religion until he is proven a muslim. The above documents have raised reasonable doubts.

    This will be mockery of the law to allow lies to cheat, steal, rob and even convert murder to look like suicide. The elder son must be hauled up for a full and open investigation to prove his claim whose words are also the action of religious authority has taken, making them look like a team(hand in hand) of people of high-handed fanatics.

    The process law must be allowed to take place. and there is no substitute for law and order without the process of common law, fair and just.

    Any judge worth his salt can see the unprofessional way the documents have been prepared and throw out the case. But in this case the Syariah Judge has used his personal feelings and his lack of knowledge as a Judge obviously, to rule for the inefficient department. I will be shy to be working in a department that cannot even get basic documents right. A classic case to ponder for the non-muslims going to the polls shortly.

    Seems very convenient that another Chinese covert to attest to the conversion. – brothers to the cause?!
    I would have expected an august body such as the shyria to have exercised more diligence, caution and care in processing conversion applications, especially in light of all the abuses and bad publicity

    it’s not Gan whom paralysed but the judiciary integrity . Blame TDM whom gave equal power to Syariah courts compared to Civil courts.

    Documents are flaws as pointed out. It shows the ugly side of those trying to perpetrate Theocratic rules in this country. They will go to all length no matter how low down in “human moral gauge” to forge, to rob, to steal and to kill to achieve their evil aim.

    The Syariah fiasco today was created by Mahathir when amendment were made to article 121 in late 80s. Now we all had to suffer the conflict of interest in our justice system. The amendment elevated Syariah house to be as powerful as Civil court, and most of judges in Civil house are Muslim anyway (Thanks to NEP) Other religion do not stand much of hope for favorable judgment.

    The sad thing is our Muslim friend they will suffer most when Syariah comes in full force under the mercy of theocratic institution with its thugs. Other races probably will migrate anyway due to their inherit competitiveness without affirmative action like NEP.

    If you do not believe me, try ask why few wants to migrate to Saudi or Iran or Libya or Iraq, but everyone wants to goto Europe ,Australia and US .

    Looking at the over-whelming flaws in the documents here makes one wonder how credible is the syariah court in Malaysia as opposed to cases in the civil courts that takes years to pass judgement.
    It seems that those entrusted to uphold Islam in Malaysia in Perkim, Pejabat Ugama, the syariah court and the BN government is making a mockery out of the religion. Isn’t religion supposed to make people a better person? Then again, this kind of ruling can only happen in the Malaysian syariah courts..again and again. What a shame!
    To the Gan family, my deepest condelences and may God bless the soul of the late Gan Eng Gor.

    Has the court verified that the thumb print is indeed the old man’s since the family members claimed at the date of the alleged conversion, the father was at a different address ?

    The son could be charged for forgery and cheat and Shasaine Siau be charged for abetting the crime (or be discipline for negligence).

    Cannot understand how the Syariah court can be so sloppy !
