right of association of an elected representative belongs to the people

The whole situation in Perak can best be described by using the Cantonese phrase “Mou Gan Tai”  literaly meaning ” No eye see” or ” don’t have the heart to see’.

Although under the Constitution, Malaysians have freedom of association, it is just morally wrong  to ignore the mandate from the people and ‘hop’. They should go back to the people to seek the people’s mandate again if they wish to change side. This applies to politicians of both divides.

Amidst accusations of millions being offer, I would like to say that to cross sides because of certain monetary or post inducement is very immoral , both in the case of the inducer as well as the recipient. By doing so, they have actually circumvented democratic principles and betray the support given to them by the people.

Yes, they have the right for free association as individuals, but as representatives of the people, this right is no longer theirs alone to exercise , but the right should rightfully belong  to the people.

Even before 916 when there was so much of hoo haa about cross over, I was of the opinion that whoever wanted to cross must resign and re contest their seats. In that case, if Anwar could have secured enough MPs to do so, resign and recontest, and these MPs could win again under Pakatan, then it would be alright to have a change of government at the time. That would be and should be the right way to do.  But of course, 916 is now academic.I was hoping then there would be changes, but even changes have to follow the wishes of the people, who are the actual bosses of the country.

As regards to the legality of the letters of resignation, and the EC’s rejection of the speaker’s ruling that the 2 has resigned, I think the famous constitutional lawyer Malik Imtiaz Sarwar has made a very good argument that EC should not be seen to be making judgemental decisions, which will be perceived to be taking side. Just heard a rumour that the State assembly will be dissolved.. Which means that the people can exert theri power again. That should be the right thing to do, as advocated by my blog article yesterday.

    Either dissolve the State assembly or hold by-elections for the two “ex-PKR” traitors.
    Its really sad and angry, with the current world economy crisis etc… and here in Bolehland we are stupid, greedy and unbecoming politicians going for each other throats for reasons they know best.
    To the 2 or to maybe 3 politicians in Perak, either quit PKR and let the rakyat decide again on the new by-elections. We have had enough of politics. Just let the rakyat decide who should represent them and then move on to help the country move forward whoever wins.

    The Sultan of Perak answers to no one and he is above manipulation. My take is that he will listen to the Perak MB to dissolve the assembly. The snap election, albeit restricted to Perak will be a most keenly watched one because it will spell the end of BN. How is UMNO going to contest this election as many of the leaders can’t even tell whether they will be in their jobs or not come April? Politics is not frustrating, it is loads of fun. Peng, I disagree with you. Otherwise, why should I read Dr. Hsu’s blog. Ha ha ha.

    Lets hope the sultan acts in a fair manner as demanded of him in his role as constitutional monarch.

    Nizar should have moved for the dissolution 2 days ago when the situation looked untenable.

    Defection in itself reflects “immoral” of that MP or ADUN.

    But defection on moral ground and clear conscience to correct a “wrong” system “right” without monetary gain or self-interest is still acceptable to me. That is the huge different between defection from BN to PR and PR to BN.

    In short, forget who start the defection first, just go for fresh General Election in Perak, better still the whole Malaysia. Once and for all.

Politics is made out of many types of personalities, those with principles, with ideologies, with greed, with hatred, with desires, with ulterior motives, with nothing but just for fun etc, etc. Which group are you belongs to?

    As klm said : third world problem requires third solution. If you think with first world mentality like DR Hsu, you will find yourself lack of audience but mere spectators who don’t give a damn to what you are trying to articulate or reason out. At the end, you are a victor of morality but loser in the real battle ground.

    Drastic change can only happen through revolution, as i said before. But we need a charismatic personality with high intelligence couple with strong conviction to set the ball rolling. when will the MAN arrive? I don’t know.

    The fact that none or little from PAS and DAP that defect shows that most of them are principled lots.

    Dangling millions, which can last generations for average Malaysian in front of the ADUNs, is indeed very tempting.

    I would vote for PAS and DAP again.
    However, PKR really lose a lot of credibility, their “senjata makan tuan” is really a good lesson to DSAI.

    Karpal Singh have consistently raise up against snatching the govt by defection, and I fully agree.

    Like in tech world, you have really succeed unless you have failed before.

    So, PR, don’t be disheartened, take this opportunity to strengthen your base and rebound back.

    Whatever happened in Perak is an organized confusion, only those with tons of money able to do it, unfortunately PR do not have the money.BN will take over Perak state govrnment and there will be no snap poll.MB of Perak had desolved the state assembly and completed his briefing with Sultan Azlan Shah at 5.30pm, hoping against hope that the sultan willl give his consent and I think the MB will be very disappointed. Like I said, those who opposed the power-that-be will either dead, disappeared or jailed, that is if they can’t buy you.

    Can you clarify when you say that BN has 28 seats and Pakatan also has 28 seats but with three remaining independent how can you have a majority?

    (The three independents) would support BN in the state assembly. In the case where there is a need to vote on any issue in the state assembly, they would support us. Whatever we decide on they will support us and they will defend the BN state government.

    What this exercise did whas to show Najib can plan, execute and win if Badawi is out of the way. This is an important message. Did you notice Badawi dont look so enthusiastic.

    That was why Tajol Rosli, a Badawi man, was removed and Najib took over.

    Whatever happened next dont really matter. Najib have stengthed his position in UMNO. He can win back Perak anytime.

    What a tumultous day today was in Perak and I do not think its over yet! This is despite Najib declaring that BN has the numbers to form a new Perak state government. (TheStar Online report HERE).

    Perak’s system of government (and Malaysia’s as well) is based on UK’s Westminster system of a democratic parliamentary system of government. Amongst the key characteristics is that parliament (in this case state assembly) may be dissolved at any time upon the request of the ‘SITTING’ MB.

    Alternatively, the opposition (UMNO/BN) may move a motion of no-confidence against the MB and his government in the state assembly and a vote is taken by all assembly persons. If the MB and the government side can’t defeat this motion, then the MB must either resign or dissolve the assembly and request for a general election.

    Despite all the MSM saying that the PR government of Perak has fallen, the fact is the PR state government under MB Mohammad Nizar Jamaluddin is STILL the sitting government sworned-in by the Royal House of Perak.

    And when MB Nizar went to see HRH The Sultan of Perak to request for a dissolution of the assembly, he did so in his capacity as the MB of Perak and by convention of the Westminster system, the Head of State (in this case HRH The Sultan of Perak) should accede to the request even though HRH does have discretionary ‘power’ empowered by the state constitution.

    My understanding of this whole fiasco is that before Najib can announce the formation of a new BN government, he must first remove the existing sitting PR government. As it stands both PR and BN now have 28 seats each with 3 independents claimed to be “BN friendly” by Najib.

    Effectively, what we have here is a hung state assembly and unless and until a motion of no confidence is moved in the assembly, the status quo remains! And the status quo is PR is the state government and Nizar is the MB! Because it is a hung assembly, the MB has chosen to face the electorate again and HRH should grant him this request. It is the honorable and right thing to do.

    In a sense HRH Sultan of Perak had been put in this unenviable position to safeguard the institution of democracy by UMNO/BN.

    What Najib is trying to do now is to ignore democratic conventions of a Westminster system and to subvert the will of the people last recorded on 8 March 2008. If Najib succeeds in carrying this off then it is a sad day for Malaysia’s democracy.

    Then it is up to us ordinary Malaysians to fight for justice and the rule of law and have this day ingrained in our memory forever. NEVER again to UMNO/BN!

    I have asked many peopel about this hopping, and most people i ahve asked today are disgusted with these sort of buying.

    That is why, even if they can buy win over the governemnt by this means, they will not endear themselves to the people… Of course, it is also wrong for the other side to entice using money, that is why i think we should go back to the people if anyone wants to alter his association..

    right now, the sentiments on the ground are very much against BN. ANd whatever initiatives coming from them will be viewed with distrust, especially when money politics is involved.

    So, to win back the people’s trust in the long run still depends on good governance and people orientated policies, and not money politics…

    It is a sad day that Malaysia under BN governance is bankrupt of whatever (is left) of political integrity, morals and values by snatching power and making a mockery of the ballot box. UMNO has “money-tised” both the electoral and corridors of powers with no respect to the people’s voting rights.

    It took only four rotten frogs with self-vested interests and personal grouses to deny the voting rights of the Perak voters and people’s democratic choice.

    I agree with Khoo Kay Peng totally. UMNO-BN has won this battle but will lose the future war, and I foresee, will be worse than 308 at the next GE, which UMNO is planting this seed now. Resentment and anger will harden and rightly so against this bankruptcy of our political culture.

    As for PKR, play by the sword, die by the sword. A bitter lesson well learned even though its political aim is on “hopping” to overthrown a rotten government is immoral except through the ballot box. This will earn more respect from the political divide. As for UMNO, this undemocratic move and disrespect to the voters has shown this corruptible party will never change its tainted ways. It’s only a matter of time, it will karmically strangle itself to death.

    Hee left because of the Ngeh-Nga cousins. Whilst effective and decisive as politicians, they lack people skills and comes across as abrasive.

    Nevertheless they are instrumental in getting a lot of things done in Perak.

    The problem is with Hee for letting the smaller issue cloud the bigger objective. I guess too much emotions involved with her.

    Yes klm, I hear it too but unfortunately for Badawi most of the UMNO warlords act on strength and they see Najib as the stronger leader despite his baggage.

    To the warlords, baggage be damned so long as their leader give them permission to do unconstitutional stuff and profit from it.

    For this country to change for the better, we have to prevent Najib from taking over as PM. UMNO has to be put in opposition for at least 2 terms before real reforms can take place.

    Failing which then we ordinary Malaysians have to fight for weak Badawi.

    It is the lesser of the 2 evils!

    Without the ability and patience to get supporters fully on your side, one can be movers but not shakers. Movers are drivers, shakers are leaders.

    Looks like this is the case in DAP Perak. You loose a link when it is most crucial. Beside a woman is more vengeful and vicious when angered.

    Just check through all her statement leading up to today and you judge for yourself whether this person is a trustworthy person ?

    Or is she just helping to cook up what MSM deems as DAP internal struggle ?

    Personally I knew the Ngeh and Nga cousins, as they are my church members.

    Ngeh is too soft-spoken to ever be abrasive, actually I wonder how he can become politician, although he is one of the most dedicated person I ever known.

    Nga is an excellent orator and indeed can be abrasive, however, the only time I heard him in that mode is in his lecture against BN.

    He is an ambitious lad, however, if you ever listened to his debates and lectures, I think you will agree that given all the odds against the Opposition, we absolutely need someone of his calibre to be up there representing our small voice.

    I just wonder how Hee Yit Foong’s friends and relatives will feel by her betrayal…. not to mention her constituent.

    romerz and petestop. What I get from you just confirm my view of the DAP Perak leadership. While well intentioned, they lack the ability to lead troops to battle. Also, some comments from Lim Guan Eng was, frankly, quite insulting.

    I read Hee is disabled. She walk with a limp , suffered from polio in childhood. That means she probably has a sensitive character and bear a pyschological scar. She is probably not suited for a soul sucking, thick-skinned job in politics.
    (Dr. Hsu, this is more your line – pyscho analysis)

    In other words, it was a mistake of DAP of putting her as a candidate and another mistake to make her deputy speaker. Maybe, DAP just lack people with ability.

    Remorse will probably set in after the anger has subside. There may be more tragedy coming from this direction. I dont think Hee can cope with the pressure she is getting from all side.

I can understand if some UMNO chaps jump ship as everyone knows how to save his own skin when the vessel is gone but jumping out from the DAP (PR-faction)? Doesn’t make sense unless it is for money. If I ever see her crossing my path, I hope to land an egg, no that is too civilize, I mean a rotten egg into her bloody face. In the old days, the emperor will order her limbs to be torn apart by four horses. Shitty woman. Not fit to be a chinese.

    The immoral practice of party-hopping often leads to the fall of democratically elected governements. Indeed there is a need to consider anti-defection laws to bear against such practice. Allowing the people to elect their wakil rakyats is one of the finest achievements of democracy. The idea that the government must be representative of the people and anwerable, responsible and accountable to the wishes of society is a firm pillar of contemporary political morality. Conversely the right to speech and association are also the essential pillars of a democratic set-up, the life-blood of a free society. So it is a subjective issue where one may argues on both sides on the commonly called ‘unethical act’ of ‘crossovers, hoppings, defections, jumping-ships’ as in our current poltical scenario.

    Unfortunately, elected assemblies are not always representative. Even in the liberal democracies of other countries, the ideals of representative government are realised only imperfectly. Though democracy is the best form of government invented by human beings, there can be no denying that behind the folklore of democracy stand many myths and many utilitarian compromises.

    On the other hand, by judicial precedent, the apex court had once decided in 1982 that an election need not be called as the mere majority was able to form the new government pertaining to the Consitution. In addition HRH is not bound by the advise of the PM or incumbent CM or the wishes of the parties but the paramount consideration is the confidence of the majority of the members of the Assembly. In any event, it must be remembered that precedents must not only look good on paper but must also function well.

    Allowing BN/PR joint government will definitely cause many problems and not practical which will lead to more losses at the peril of the people.

    Will it be a bad precedent if a government is formed due to the defectors’ support? If yes, Anwar Ibrahim may just has to wait for the next general election.

    Remember that before 308, DAP was just a small underdog ? Nobody gave them any chance.

    Unfortunately many good people never wants to sign up to DAP, they prefer to sit in kopitiam (and nowadays in the blogs) and curse the govt.

    Obviously there is no profit in joining DAP,
    better join MCA or other BN component.

    They are just fighting for their ideology of democratic socialism, social justice for all.
    Which, need I remind is suppose to be the same
    ideology for Gerakan, which the have but abandoned since they joined BN.

    So many of the DAP leaders have to play multiple role, that is why many of them had to contest for both state and parliament.

    Ngeh and Nga are both successful lawyers, they don’t really need to be in politics. They have already have a comfortable life.
    Yet they, especially Ngeh Koo Ham, still puts a lot of volunteer time into our church, despite his hectic schedule.

    I would say that DAP have given a great platform and opportunity to Hee, for the disabled and the underrepresented.

    Yet the moment she got a glimmer of power and $$, she decides to jumps ship.

    What have she ever done for Perak to deserve the rights to be the power-monger in Perak against the wishes of millions of Perakians ?

    petestop. You are spot on. That is the fundamental weakness of DAP. Galvanising the people and rallying them to its cause. This is still something it is not doing well. As you said, most Malaysian are armchair politicians. Just sit and talk and blog (like me). Without a base to build on, it is hard.

    On another note, I saw this in another blog (harisibrahim)

    In 1982, the Federal Court in the case of Sarawak United People’s Party (SUPP) member Datuk Ong Kee Hui versus the then party chief Sinyium anak Mutit ruled that the arrangement of submitting an undated resignation letter to the Speaker was contrary to public policy and therefore void.

    I think one of the judge was Azlan Shah – present Sultan of Perak. It may be tough for him to argue out of this.

    Finally, whatever the outcome, we have to accept it. This is part and parcel of democracy. We may not like some of the results of democracy, but we have to live with it.

    Whoever say democracy is clean, moral and upright is a fool.

    And, at least we live another day to fight for what we think is correct. Democracy give us this. In other systems we will be in the Gulag. Just think about this. So don’t get mad, get even.

    All the known facts are there, we just need to be patient to wait for the Sultan to arrange and put everything in proper order. Right or wrong is up to individual to judge. Due process must be adhere to, that is important.

    Interesting to note that all other BN component parties are all bystander in this high drama except UMNO. Probably all of them have gave their mandate to UMNO to perfect the final touch. What say you, Dr. Hsu? Show us your justification to remain in the coalition that don’t need you and Gerakan to be around. Suddenly, i realise that the man who understand what principle meant are those who can even write or spell that magic word but not those who would define it according to many perspective they deemed right.

    DAP’s integrity is still there even though one HYF has defected. However, their problem is they seriously lack of elected member with quality. Perhaps there many within them but LGE & gang hinder their emergence, i am only guessing as i m an outsider.

    MCA, what more need i say. They are the Chinese representative of the Big patronage system practice by BN. Just go to any village and you will see how their system work prior to GE308 or even now in those state BN controlled.

    MIC is dead especially the chief. No amount revival skill could reestablish its influence it once commanded so long as Hindraf is alive.

    Yet i must say that anything is possible in politics. The caveat is one must quickly find a way to make their party become relevant to the rakyats aspiration, be it just perception or real.

    “Face it, deal with it, leave it as it is” These are the three steps of Master Shen Yen’s way of dealing with problem. May Dr Hsu find the meaning in it when deciding your next move. My negative comment on you and Gerakan are only meant to add another dimension in your critical thinking process.

    The “bastardization” of our impeccable Westminster system has ended with UMNO-BN’s fangs successfully clawing back control of Perak state. At what costs?

    The peoples are the biggest losers. Lessons of this episode need to be remembered.

    The law of the jungle rules, naked power and all.

    Malaysia has scored another shame. We can no longer depend on our rulers to uphold democratic principles.
